Terms and Conditions
These Terms & Conditions (“Terms”) govern all purchases, sales, and use of products supplied by Kailash Seed (“Company”). By purchasing or using our seeds and related products, you (“Customer/Buyer”) agree to be bound by the following Terms:
1. Product Quality & Liability
- Kailash Seed assures that the seeds supplied are of standard quality as per applicable laws and industry norms.
- The Company does not guarantee yield or outcome, as these factors are beyond our control.
- However, seed performance depends on external factors such as soil conditions, climate, irrigation, fertilizer, pest control, and farming practices.
2. Use of Seeds
- Seeds purchased are strictly for agricultural use only.
- Buyers must follow the recommended cultivation practices provided by the Company or authorized representatives.
- Any misuse or improper storage of seeds that results in poor performance will be the sole responsibility of the Buyer.
3. Pricing & Payments
- Prices of seeds and related products will be communicated at the time of order.
- Payments must be made as per the agreed terms (cash, online transfer, or credit arrangements, if applicable).
- The Company reserves the right to revise prices without prior notice.
4. Delivery & Risk
- Seeds shall be delivered to the Buyer at the agreed location.
- Risk of loss, damage, or deterioration of seeds passes to the Buyer upon delivery.
- The Company shall not be liable for delays caused by transportation, strikes, natural calamities, or other unavoidable circumstances.
5. Replacement Policy
- If seeds are found to be defective in quality, the Buyer must notify the Company within 15 days of delivery with valid proof (lot number, purchase invoice, field report, etc.).
- After verification, the Company may offer replacement seeds of equal value.
- The Company’s liability is strictly limited to seed replacement only. No claims for crop loss, compensation, or damages will be entertained.
6. Intellectual Property
- All trademarks, logos, and branding of Kailash Seed are the property of the Company.
- Buyers are not permitted to reproduce, sell, or rebrand the seeds without written consent from the Company.
7. Compliance
- Buyers are responsible for ensuring compliance with all applicable agricultural, environmental, and legal requirements while using our seeds.
- Any violation of government regulations in seed usage will be the responsibility of the Buyer.
8. Limitation of Liability
- The Company shall not be responsible for any indirect, incidental, or consequential losses resulting from the use of seeds.
- The Buyer agrees that the maximum liability of the Company shall not exceed the value of the seeds purchased.
9. Governing Law & Dispute Resolution
- These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
- Any disputes shall be subject to the exclusive jurisdiction of the courts located in [City/State of Kailash Seed’s Head Office].
10. Acceptance
- By purchasing and using seeds from Kailash Seed, the Buyer acknowledges and agrees to all the above Terms & Conditions.
